Does General Liability Cover 1099 Workers in Massachusetts?
January 18, 2024

Many Massachusetts businesses rely on independent contractors — also known as 1099 workers — to handle specialized tasks without the overhead of full-time employment. But when it comes to insurance, the classification of workers as employees versus independent contractors has significant implications.
What General Liability Insurance Covers.. A commercial general liability (CGL) policy protects your business from third-party claims of bodily injury or property damage caused by your business operations, products, or completed work. It covers claims from customers, vendors, and members of the public — not your own workers.
Does It Cover 1099 Workers?. This is where many businesses make a costly assumption. Whether an independent contractor is covered under your general liability policy depends on the policy's language and the specific situation. Generally speaking: if a 1099 worker causes injury to a third party while performing work for your business, your general liability policy may provide coverage. However, if the independent contractor is injured themselves, your general liability policy does not cover their injuries — that's what workers' compensation is for.
The Misclassification Risk.. Massachusetts has strict rules about worker classification. If you call workers 1099 contractors but they function as employees under the state's three-part ABC test, they may be reclassified as employees. This could expose you to workers' compensation liability, back taxes, and penalties.
Should Your 1099 Contractors Carry Their Own Insurance?. Yes. Best practice is to require all independent contractors to carry their own general liability insurance and provide a certificate of insurance (COI) naming your business as an additional insured. This protects you if a contractor causes damage and their own coverage is insufficient.
Subcontractor Coverage Endorsements.. If you regularly hire subcontractors, talk to your insurance agent about adding a subcontractors endorsement to your policy to ensure their work is covered under your completed operations coverage.
